Stellar Privacy Policy

This privacy policy applies to information collected and used by Stellar Labs, Inc. (“Stellar”, “we” and “us”) through use of the Stellar mobile application (the “App”), the stellar.aero website (the “Site”) and other online products and services provided by Stellar (collectively, with the App and the Site, the “Service”). This privacy policy should be read in conjunction with the Stellar Terms of Service (the “Terms”) at stellar.aero/legal/terms.html. Capitalized terms not defined in this privacy policy are as defined in the Terms. Your use of the Service indicates your acceptance of this privacy policy.

Information We Collect From You

In order to operate the Service and to provide you with information about products or services that may be of interest, we collect information about you. This includes but is not limited to your name and contact information such as phone numbers, email and mailing addresses, birthdate, gender as well as your profile picture. In addition, you may provide payment information either through transmission through the Service or otherwise, which could include bank account, or credit or debit card numbers or other information.  

We collect details related to your searches and requests for transportation through the use of the Service, and how you interact with the service. 

We will collect any communications that relate to the Service and the transportation arranged for through the use of the Service, such as SMS messages and emails.

We may also collect information about the device or computer used in connection with the Service, such as the type of device, the model, the operating system and software, browser, information, unique device identifiers, and mobile provider. We also may collect information regarding the access of the Service, such as the dates and times of access, device IP addresses, and other sites that you have visited prior to the use of the Site. We also collect information from your mobile device regarding your location. 

Use of Information

We may use the information we collect about you to facilitate the transportation and logistics you have arranged for through the Service, including for payments, confirmations and updates, and to help us operate, maintain and improve the Service. 

We may communicate with you regarding the Service and other products and services provided by Stellar and third party providers; news relevant to Stellar and its industry; and for promotions, contests, sweepstakes, all in accordance with applicable law.

Sharing of Information

We may share your personal information with the third party air carriers and other providers who are providing the transportation and logistics services to you for flights arranged through the Service. We may also share your information with agents, representatives, contractors, vendors, consultants, marketing partners, and other service providers who need access to such information to carry out work on our behalf, related to the Service. This may include third parties with other apps or websites that integrate with our API or the Service, or those with an API or other service with which we integrate.

We may share your personal information with third parties to provide you a service you requested through a partnership or promotional offerings. 

By accessing and using the Service, you understand that we are providing your personal information to third parties as listed in this privacy policy. These third parties may use your personal information in accordance with their own privacy policies. Additionally, you agree that we may use and disclose all such information so submitted to such third parties in the same manner in which we are entitled to use and disclose any other information you provide to Stellar. You agree that Stellar are not responsible or liable for any of their actions or omissions.

Content that you submit in a public forum will be made generally available. 

We may release your personal information when we believe in good faith that release is necessary to comply with applicable law or governmental regulations, including laws outside your country of residence; enforce or apply the Terms, or protect the rights, property, or safety of others. This includes exchanging information with other companies and organizations (including outside of your country of residence), private or governmental.

We may share your personal information in an aggregated and/or anonymized form which cannot reasonably be used to identify you.

We may share your personal information in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company. In addition, if Stellar, or substantially all of its assets are acquired, whether through a merger, consolidation, stock purchase or otherwise, or in the event that Stellar goes out of business or enters bankruptcy, user information (including personal information) would be one of the assets that is transferred or acquired by a third party.

We and our third party service providers use technologies like cookies, pixels, and local storage on our website, in our emails, and other identifiers to provide you with a range of products and services. You can control cookies through your browser settings and other tools. By continuing to use the Service through your device or computer, you consent to our use of cookies, pixels and local storage in accordance with this privacy policy.

We may work with advertisers or other partners and advertising service providers to serve ads or services to your mobile device or computer, which may use a cookie, pixel or other similar technology placed by Stellar or the third party (although we would not share any other information that identifies you with an advertiser). This privacy policy covers the use of cookies by Stellar and its service providers and does not cover the use of cookies by any advertisers. 

California Privacy Rights

California law permits residents of California to request certain details about how their information is shared with third parties for direct marketing purposes. Stellar does not share your personally identifiable information with third parties for the third parties’ direct marketing purposes unless you provide us with consent to do so.

Safeguards

We try to safeguard user account information, including personal information. However, no one can guarantee the security of user account information. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

Your account information (including personal information) is protected by a password set by you for your privacy and security. You are responsible for preventing unauthorized access to your account and personal information by selecting and protecting your password appropriately, and restricting access to your device and computer.

The Service may contain links to other sites. Stellar is not responsible for the privacy policies and/or practices on other sites. When linking to another site, you should read the privacy policy stated on that site. This privacy policy only governs information collected on the Service.

Your information may be transferred to and maintained on computer networks which may be located outside of the state, province, country or other governmental jurisdiction in which you reside, and the country or jurisdiction in which these computer networks are located may not have privacy laws as protective as the laws in your country or jurisdiction. Your access to and use of the Service or your submission of any personal information to us will constitute your consent to the transfer of your personal information outside of your home country or jurisdiction.

Even after you remove information from your account or profile, copies of that information may remain viewable elsewhere, to the extent it has been shared with others, or it was copied or stored by other users. Removed and deleted information may remain on backup media for a period of time prior to being deleted from our servers.

Changes to Privacy Policy.

We reserve the right to amend this privacy policy from time to time, and encourage you to review it periodically. Use of information we collect now is subject to the privacy policy in effect at the time such information is used. If we make material changes in the way we use personal information, we will notify you through the Service or sending you an email or text. Users are bound by any changes to the privacy policy when they use the Service after such changes have been first posted.
